1. Applicability
These terms of use apply to all services provided by SCHOLA-21.
2. Registration
(1) Use of SCHOLA-21 requires prior registration.
(2) Registration involves completing an online form and receiving user authorisation from the German Children and Youth Foundation gGmbH (GCYF).
(3) The GCYF reserves the right to request additional requirements such as proof of age before providing the services of the SCHOLA-21 platform.
(4) By registering for SCHOLA-21, you are applying for a user contract with the German Children and Youth Foundation gGmbH. The contract is free of charge.
3. Scope of services
SCHOLA-21 is a privately sponsored programme. The services of SCHOLA-21 are therefore provided free of charge, but only as far as the technical, operational, and financial capabilities of the GCYF permit.
4. User obligations and responsibilities
(1) You agree not to share your password with third parties and to protect it from unauthorised access by third parties. You further agree to inform the GYCF immediately when you notice that your password is being used by third parties in an unauthorised manner.
(2) Use of SCHOLA-21 is restricted to youth and educational work in and out of school. You agree not to use the provided services for commercial or other non-educational purposes.
(3) When publishing information, e.g. via project homepages, you agree to present it in such a way as not to harm the public image and reputation of SCHOLA-21.
(4) You agree not to violate any applicable local, state, national, or international law when using the services of SCHOLA-21. You agree in particular to include only such materials that are not protected by the rights of third parties (especially copyrights, rights to control the use of one’s image, personal rights, etc.)
(5) You further agree not to publish or disseminate any illegal or morally harmful contents such as extremist propaganda, racist ideas, pornographic content, insults and other offensive or humiliating statements.
(6) When creating homepages with SCHOLA-21, you agree to comply with German legal information requirements by adding the required publishing information (“Impressum”).
(7) With special regard to the protection of third-party rights, the GCYF reserves the right to remove, on a short-term or permanent basis, texts and other materials published via the portal or to prohibit their initial publication.
(8) If users fail to comply with the obligations set out in paragraphs 1 to 6, the GCYF is entitled to block their access to SCHOLA-21 or to restrict or revoke their current user rights.
(9) You agree to indemnify, release, and not hold liable the GCYF from any claim, action, demand, loss, or damages made or incurred by any third party arising out of or relating to your violation of the obligations defined above. You further agree to support the GCYF in defending itself against aforementioned claims by making statements to this end, especially statutory declarations, and by providing other kinds of information. You further agree to work towards the effect that any third-party claims will be directed against yourself.
5. Liability
(1) The GCYF shall be liable for any culpable damage resulting from a breach of the material contractual obligations.
(2) If the breach of these material contractual obligations was merely due to slight negligence, the amount of the GCYF’s liability is limited to the damage typically foreseeable for this kind of contract. It does not include any indirect damage.
6. Termination
(1) Users can terminate their SCHOLA-21 membership at any time one day before the end of the following calendar day. The GCYF can give notice of termination at any time within a 14-day period.
(2) The right to termination for cause without notice shall remain unaffected.
(3) Notices of termination must be made in writing. A notice of termination by email shall satisfy this requirement.
(4) After users have terminated their membership, the content they have provided within the project area and the community area (separate registration required) shall remain visible and available.
7. Privacy policy
(1) In order to enable you to use SCHOLA-21, the GCYF collects, processes, and uses the personal information you are required to provide for registration.
(2) You agree to notify the GCYF immediately of any changes to your personal information, especially to your email address.
(3) Your personal information is protected by the GCYF. The GCYF does not share your personal information, except to comply with legal obligations.
8. Final provisions
(1) All legal relationships between the contract parties resulting from the use of SCHOLA-21 services are subject to German law.
(2) Should any provision of these terms of use be or become wholly or partially invalid under applicable law, the remaining provisions will continue in full force and effect.
